ORDINANCE NO. 34
 
USE OF FIGHTING WORDS
 
 
An ordinance relative to the use of “Fighting Words”.
 
THE VILLAGE OF FAIRGROVE ORDAINS:
 
Section 1. No person shall address any offensive, derisive or annoying word to any other person who is lawfully in any street or other public place, nor call him by an offensive or derisive name, nor make any noise or exclamation in his presence and hearing with intent to deride, offend, or annoy him, or to prevent him from pursuing his lawful business or occupation.
 
Section 2. Any person convicted of violating any provision of this Ordinance shall be punished by a fine of not to exceed $100.00 or by imprisonment not to exceed 90 days or by both such fine and imprisonment, at the discretion of the Court.
 
Section 3. Each section of this Ordinance and each provision of any section shall be considered separable and the invalidity of any portion of this Ordinance shall not affect the validity or enforcement of any other portion.
 
Section 4. This Ordinance shall become effective after publication and expiration of the time prescribed by law.
 
ADOPTED June 2, 1980.
