Sanitary Sewer/Storm Sewer Funding

 

Resolution to transfer funds from the sanitary sewer system to the storm water drain to pay for repairs of damages done to the storm water drains during the installation of the sanitary sewer.


WHEREAS, the Village of Fairgrove established a sanitary sewer system in the 1970’s,

WHEREAS, during the installation of residential sewer lines, every residence, where a storm drain main was located, the sewer contractor cut through the storm drain mains.

WHEREAS, the sanitary sewer contractor then patched the severed storm drain mains using substandard methods.

WHEREAS, Monchilov Excavating has use robotics to camera the storm drains, and found a consistence pattern of substandard patches throughout the storm water drains.

WHEREAS, in the summer of 2015, two (2) substandard storm water drain patches failed. Each repair cost approximately $2000. One example of when a substandard patch was used is that 10 inch storm drain main was cut, then patched with an 8 inch main being placed in the ends of the 10 inch main. This patch allowed storm water to escape though the gaps, eroding the area and causing roadway failure.

WHEREAS, problems to the storm water drains are directly related to the installation of the sanitary sewer system. Actions of the contractors during installation of the sanitary sewer system, through substandard patches to the storm water mains, are now costing the village costly repairs and damages to roadways and driveways.

WHEREAS, the statutes of limitation does not allow the village to seek damages from the contractor who installed the sewer system.

WHEREAS, the storm water drain mains are failing and are unable to remove storm water, causing a secondary problem to the sewer system. This activity has contributed to the illegal storm water discharge to the sanitary sewer system.

WHEREAS, during storm events the sanitary sewer system is impacted by a large volume of storm water. This information has been documented and reported from a Fairgrove Village employee to the Fairgrove Village Council.

WHEREAS, the improper discharge of storm water to the sanitary sewer system has caused wear and tear on the lift station pumps.

WHEREAS, the storm water problems and the storm water drain are directly related to the installation of the sewer system within the Village of Fairgrove.

NOW THEREFORE, BE IT RESOLVED that the Village will take proactive steps to prevent costly repairs to the storm drain main that were directly related to the actions of the contractor during the installation of the sanitary sewer installation.

BE IT FURTHER RESOLVED that the repairs to the storm drain will also prevent the improper and illegal discharge of storm water to the sanitary sewer system.

BE IT FURTHER RESOLVED that prevention of storm water discharge to the sanitary sewer system will prevent costly repairs to the lift station and the pumps.

BE IT FURTHER RESOLVED that a portion of the cost of the storm drain mains damage that was caused by the installation of the sanitary sewer, be funded by the sanitary sewer fund.
