ORDINANCE NO. 52
NON-PARTISAN ELECTIONS
THE VILLAGE OF FAIRGROVE ORDAINS:
Section 1. That the election of all village officials for the Village of Fairgrove shall be held on a non-partisan basis, and candidates for all such offices shall stand for election on a non-partisan basis as authorized by Section 3, (MCL 63.3) of the General Law Village Act, PA 3 of 1895, as amended and PA 255 of 1998.
Section 2. That this ordinance shall apply beginning with the first village election for which the nomination deadline is not less than thirty (30) days after the effective date of this ordinance.
Section 3. That this ordinance shall take effect forty-five (45) days after the date of its adoption unless a petition signed by not less than 10% of the registered electors of the village is filed with the village clerk within the forty-five (45) day period, in which case this ordinance takes effect upon approval at an election held on the question.
Notice of the delayed effect of this ordinance and the right of petition under this subsection shall be published separately at the same time, and in the same manner, as the ordinance is published pursuant to Section 4 of chapter VI of the General Law Village Act. The village clerk shall verify the signatures on the petition. If a petition bearing the required number of valid signatures of electors is filed, the question of adoption of the ordinance shall be submitted at the next general or special election. The ballot language for the question shall be prepared by the village clerk.
Section 4. That all elections will be held at the time of the general election and the village will not conduct a primary election. The person receiving the highest number of votes shall be declared the elected winner for a single office. If more than one position is open, the first opening will go to the person who receives the highest number of votes, the second opening will go to the person who received the second highest number of votes, and if there are more than two positions available, this procedure will follow until all positions are filled.
Section 5. That the village that has adopted an ordinance providing for non-partisan elections may revert to partisan elections by the same process as provided in subsection (1), (2), and (3).
Section 6. That the Village President or his designee shall arrange for the required publication of a notice of adoption of this ordinance and publication of notice of the right of petition, as stated above.
Section 7. That this ordinance shall be adopted by an affirmative vote of at least two-thirds (2/3) of the members of the village council.
