ORDINANCE NO. 32
PARK HOURS
An ordinance closing the Fairgrove Area Park during certain hours.
THE VILLAGE OF FAIRGROVE ORDAINS:
Section 1. Definitions. Fairgrove Area Park: “Fairgrove Area Park” is the Municipal Park which is located within the Village limits of Fairgrove. There is only one municipal park within the Village limits; this park is also referred to as the “Fairgrove Recreational Area”.
Section 2. Hours of Operation. The Fairgrove Area Park shall be opened daily to the public between the hours of 7 o’clock A.M. and 10:30 o’clock P.M.; and it shall be unlawful for any person or persons (other than village personnel conducting village business therein), to occupy or be present in said park during any hours in which the park is not open to the public.
Section 3. Special Activities. Whenever any individual, group, association or organization desires to use said park facilities for a particular purpose, such as picnics, parties or theatrical or entertainment performances, said individual, a representative of said group, association or organization shall first obtain a permit from the Village clerk for such purposes. The village council may adopt an application form to be used by the Village Clerk for such situations.
The Village Council shall grant the application if it appears that the individual, group, association or organization will not interfere with the general use of the park by the individual members of the public and if the said individual, group, association, or organization meets all other conditions contained in the application. The application may contain a requirement for an indemnity bond to protect the village from any liability of any kind or character and to protect village property from damage.
Section 4. Penalty. A violation of this ordinance shall be punished by a fine not exceeding $100.00 and costs of prosecution or by imprisonment in the County jail not to exceed 90 days, or by both such fine and imprisonment in the discretion of the Court.
Section 5. Severability. Each section of this ordinance and each provision of any section shall be considered separable and the invalidity of any portion of this ordinance shall not affect the validity or enforcement of any other portion.
Section 6. Effective Date. This Ordinance shall be effective after publication and expiration of the time prescribed by law.
