ORDINANCE NO. 26
SALE OF PUBLIC BUILDINGS & GROUNDS
An ordinance to permit the sale of public buildings and public grounds by private sale.
WHEREAS, Act 67, S 1, Michigan Public Acts of 1974, provides for the private sale of public grounds and public buildings by the Village Council, and
WHEREAS, the Village Council of the Village of Fairgrove deems it to be expedient and proper from time to time, to dispose of public buildings or public grounds through a private sale, therefore;
THE VILLAGE OF FAIRGROVE ORDAINS:
Sec. 1. Pursuant to Act 67, S 1, Michigan Public Acts of 1974 (MCLA 64.7 as amended) the Village of Fairgrove is hereby empowered to sell at private sale such public grounds and public buildings as is permitted by law.
Sec. 2. The terms and conditions of said private sale shall be presented to the Village Council at regular or special meeting, duly called, of the Council, and a majority of the Trustees then in office shall be required to approve each such sale.
Sec. 3. The Village President and Clerk are authorized to execute any such deeds, contracts and other agreements on behalf of the Village Council as may be required.
Sec. 4. If any section, paragraph, sentence, clause or phrase of this Ordinance shall be held invalid, the same shall not affect any other part of the Ordinance.
Sec. 5. All Village Ordinances and Resolutions or a part thereof, insofar as the same may be in conflict therewith, are hereby repealed.
Sec. 6. This ordinance shall take effect immediately after publication in the Farm & Town Enterprise.
