VILLAGE OF FAIRGROVE

The meeting was called to order at 7:30 p.m. by President Maguire.
 
Motion Adams second Eurich to accept the February 16, 2009 regular meeting minutes as printed.    Carried.
 
Fire Chief Young reported that the department had no runs for February 2009.
 
Police Chief Sherrod presented his department’s statistics for February 2009.
 
Correspondence was received from Michigan Department of Transportation providing the agenda for the upcoming informational meeting Monday, March 9, 2009 at 9:00 a.m. at the Cass City office.
 
The 2009-10 Budget and Truth in Taxation Hearing began at 8:00 p.m. and concluded at 8:23 p.m.
 
Motion Hoag second Farnum to adopt the 2009-10 Budget and Truth in Taxation figures as follows:
                                    General Fund                          $ 241,092
                                    Major Street Fund                         49,100
                                    Local Street Fund                       116,700
                                    Equipment Fund                         113,260
                                    Sewer Fund                                 105,400
 
                                                Total                               $ 625,552
 
Taxes will be levied at the amount allowable by law, which currently is 12.5 mills less any Headlee Tax Amendment reductions (MCL 211.34) and 1 mill will be levied for local highway and street purposes (MCL 69.2)    Carried.
 
Village Attorney Gary Howell issued an attorney opinion on how the council could proceed with removing illegal storm sewer connections from the sanitary sewer system. With owner consent the village may inspect properties for compliance but without owner consent an administrative search warrant would have to be issued by a judge to gain access to determine compliance. It was also the village attorney’s position that abandoning the storm water drainage system would not release the Village from liability. The DPW committee will meet to gather additional information on how to proceed.

Motion Hoag second Hall to adopt Resolution 02-09 American Recovery & Reimbursement Act 2009.    5 Yea    1 Nay    Carried.
 
The clerk presented some facts about the Open Meetings Act and reminded the council of the zoning board of appeals process for addressing variance requests.
 
MotionAdams second Eurich to have zoning enforcement performed by Wally Prusi at $10 per hour beginning April 1, 2009.    4 Yea    2 Nay    Carried.
 
The clerk informed the council that the economic stimulus grant package template for the village’s storm sewer replacement project was completed and sent to the necessary parties. The council was also reminded that the 5-year park plan expires 12/31/09 and the 2010-2014 plan will need to be in place if the council wants to proceed with applying for any state or federal grants.
 
Motion Adams second Hoag to establish e-banking capabilities for automatic payroll direct deposit for village employees at an approximate cost of $150 per year and for automatic bill paying of village property owner’s sewer billings beginning 4/1/09.    Carried. 
 
Motion Hall second Adams to appoint, per the Open Meetings Act, village clerk Beverly Parsell as the Open Meetings Act Compliance Officer to handle meeting postings and questions with this being a non-compensatory position.    Carried.
 
Motion Adams second Hall to pay bills of approximately $43,380.32.    Carried.

RESOLUTION 01-09
 
VILLAGE OF FAIRGROVE
 
TUSCOLA COUNTY HAZARD MITIGATION PLAN
 
 
WHEREAS, the Village of Fairgrove, Michigan is vulnerable to a wide range of natural, technological and human-related hazards, and has experienced repetitive disasters that have caused loss of life, damaged commercial, residential and public properties, displaced citizens and businesses, closed streets and presented general public health and safety concerns; and
 
WHEREAS, Tuscola County has prepared a Tuscola County Hazard Mitigation Plan that provides an understanding of those threats, identifies the hazards affecting the area, discusses the county’s vulnerability to the identified hazards, and outlines the community’s options and strategies to reduce overall damage and impact from natural and technological hazards; and
 
WHEREAS, the Tuscola County Hazard Mitigation Plan represents the interests and needs of the Village of Fairgrove;
 
NOW, THEREFORE, BE IT RESOLVED:
 
The Tuscola County Hazard Mitigation Plan is hereby adopted as an official plan of the Village of Fairgrove.

RESOLUTION 02-09
 
VILLAGE OF FAIRGROVE
 
AMERICAN RECOVERY & REINVESTMENT ACT OF 2009
 
RESOLUTION IN SUPPORT OF STIMULUS FUNDING TO LOCAL GOVERNMENTS
 
WHEREAS, President Barack Obama and the U.S. Congress have approved the “American Recovery and Reinvestment Act of 2009”, a several hundred billion dollar economic stimulus package; and
 
WHEREAS, the effort is to put millions of people to work on “ready to go” infrastructure projects that will benefit local governments around the country; and
 
WHEREAS, it is extremely important that these funds are sent to local communities directly to allow selection of the most beneficial projects in terms of infrastructure investment and jobs; and
 
WHEREAS, the Village of Fairgrove has identified an infrastructure project of the highest importance,
 
NOW, THEREFORE, BE IT RESOLVED that the Village of Fairgrove, Michigan, urges congressional support for the overall infrastructure stimulus program as well as a direct sub-allocation, as contained in current law, allowing local governments to select projects that would provide the most benefits to the community in terms of infrastructure investment and jobs, and;
 
IT IS FURTHER RESOLVED that a copy of this resolution be sent to Governor Jennifer Granholm, U.S. Senator Carl Levin, U.S. Senator Debbie Stabenow, U.S. Representative Dale Kildee, State Senator James Barcia, State Representative Terry Brown and the Michigan Municipal League.
